Changes are planned to the I-539 and I-765 forms used in U.S. immigration applications. If the regulation takes effect, only the updated forms will be accepted from September 15, 2026, while older versions will be rejected without being processed.
The new versions of Form I-539, used to extend or change status, and Form I-765, used to apply for employment authorization, should not be submitted before September 15.
People who may be affected by the new regulation
- F-1 students
- J-1 exchange program participants
- Foreign media workers
- People seeking to extend or change their status
- Spouses and children with H-4 status
- People applying for employment authorization
The planned change will also cover the system governing the length of stay for people with F, J and I status on the same date. Under the new system, the length of stay in the U.S. will be limited to a specific date, and people whose authorized period is insufficient will need to apply for an extension.
People with H-1B status are not directly covered by the change. However, family members with H-4 status and people seeking to change from student status to H-1B status will need to follow the new rules.
The date on the form to be used should be checked before submitting an application.
