Two US businesses file class-action suit over tariffs on 60 countries
The class-action complaint filed with the US Court of International Trade argues that the 10 to 12.5 percent tariffs, affecting 99.4% of imports, exceed the authority granted by Congress and are arbitrary.
Two businesses have filed a class-action lawsuit in the US Court of International Trade against the Trump administration's new tariffs on 60 trading partners.
The complaint argues that the 10 to 12.5 percent tariffs exceed the authority granted to the executive by Congress under Section 301 of the Trade Act of 1974. It also states that the measure is arbitrary and unjustified.
The US Trade Representative had announced the tariffs on the grounds that existing measures were insufficient to prevent the import of goods produced through forced labor. The move came after the Supreme Court found tariffs imposed under IEEPA unlawful. It was also taken shortly before the expiration of the temporary 10 percent global tariffs under Section 122.
