U.S. District Judge Timothy Kelly issued a 14-day temporary restraining order allowing CNN, MS NOW and Politico to reenter the White House.
The order will remain in effect while the outlets’ lawsuit against the Trump administration proceeds. Kelly noted that the media organizations were not notified or given an opportunity to respond before their press credentials were revoked, and that the Trump administration had not challenged this point.
Judge rejects national security defense
The judge rejected the White House’s defense of the access ban on national security grounds. Kelly noted that when President Trump announced the ban, he emphasized the outlets’ “false” and negative coverage rather than national security as the reason.
Trump announced the ban on Friday and repeatedly accused CNN, MS NOW and Politico of publishing “fake news.” Trump said other media outlets could face similar measures and later described the decision as a ban targeting the “free press,” saying he did not want to see these organizations inside the White House.
Trump also said the decision was not based on a single report, but on what he described as the outlets’ negative coverage over many years.
Three outlets sue over alleged retaliation
CNN, MS NOW and Politico filed a lawsuit arguing that the administration retaliated against them because of their reporting. The outlets argued that other journalists who feared facing similar restrictions could also be pressured to alter their coverage.
In his ruling, Kelly said the government’s taking action against the press because a public official disliked the content of its reporting would be incompatible with the freedom of the press protected by the First Amendment.
Before Wednesday’s hearing, Trump described Kelly as “completely disloyal” in a social media post. Trump also said the administration would appeal if the ruling went against it.
The White House did not immediately respond to a request for comment after the ruling.
